Please read these Terms and Conditions carefully before using our website, mobile application, and related services.

IMPORTANT — PLEASE READ CAREFULLY: By accessing or using the Farz Academy website (www.farzacademy.com), its mobile application, or any related services, you agree to be legally bound by these Terms and Conditions. If you do not agree, please discontinue use of the platform immediately. These Terms constitute a binding legal agreement between you and Farz Auxiliar Academy Private Limited.
1. INTRODUCTION
These Terms and Conditions of Use ("Terms") govern your access to and use of the website located at www.farzacademy.com ("Website"), the Farz Academy mobile application available on Google Play ("App"), and all related content, courses, webinars, practice materials, mock tests, live classes, and other services offered by Farz Auxiliar Academy Private Limited (collectively, the "Services"). Farz Auxiliar Academy Private Limited is a company incorporated under the Companies Act, 2013, with its registered office at 19A, Dr Suresh Sarkar Road, Ground Floor, Entally Post Office, Kolkata, West Bengal – 700 014, India ("Company", "we", "us", or "our"). The Company is engaged in providing specialised online medical examination preparation courses, including but not limited to courses for the MRCP (Membership of the Royal Colleges of Physicians) examinations (Parts 1, 2 Written, and PACES) and the EDIC (European Diploma in Intensive Care) examination. These Terms should be read in conjunction with our Privacy Policy, which is incorporated herein by reference and forms an integral part of this agreement.
2. DEFINITIONS
In these Terms, the following words and expressions have the meanings assigned to them below: "Account" means the personal user account created by you on the Platform upon registration. "Content" means all text, data, information, images, videos, audio, documents, questions, answers, explanations, course materials, mock tests, and any other material available on the Platform.
"Course" means any online course, programme, module, or educational product offered or made available by us through the Platform, including live classes, prerecorded lectures, practice question banks, mock tests, and PACES residential programmes. "Enrolment" means the act of registering for a specific Course and the consequent grant of access rights to that Course on payment of the applicable Fee. "Fees" means the applicable fees, charges, and taxes payable by you for access to a Course or any other paid Services offered on the Platform. "Platform" means collectively the Website (www.farzacademy.com) and the mobile application. "User" means any individual who accesses or uses the Platform, whether or not registered, including students, medical professionals, and visitors. "User Content" means any content, data, feedback, quiz responses, testimonials, or other material submitted, uploaded, or transmitted by you through the Platform. "Webinar" means any live or pre-recorded web-based seminar, lecture, or interactive session conducted or facilitated through the Platform.
3. ELIGIBILITY
To access or use the Services, you must satisfy all of the following conditions:
- •You are at least 18 years of age, or of the age of majority in your jurisdiction of
residence, whichever is greater.
- •You have the legal capacity to enter into binding contracts under applicable law.
- •You are not barred or otherwise legally prohibited from accessing or using the
Services under the laws of India or any other applicable jurisdiction.
- •Where you are a medical professional, you hold or are pursuing qualifications that
make the Courses relevant to your professional development. By registering for an Account or enrolling in any Course, you represent and warrant that you meet all of the eligibility criteria stated above. We reserve the right to verify your eligibility at any time and to terminate or suspend your Account if we have reasonable grounds to believe that any eligibility requirement has not been met.
4. ACCOUNT REGISTRATION AND SECURITY
4.1 Registration
To access certain features of the Platform, including Course enrolment, you must create an Account. During registration you agree to provide accurate, current, complete, and truthful information and to promptly update such information if it
changes. Providing false or misleading information may result in immediate suspension or termination of your Account.
4.2 Account Credentials
You are solely responsible for maintaining the confidentiality of your login credentials (username and password). Your Account is for your personal, non-commercial use only and must not be shared with, transferred to, or used by any other person. You must immediately notify us at info@farzacademy.com if you become aware of any unauthorised use of your Account or any other breach of security.
4.3 Responsibility for Account Activity
We shall not be liable for any loss or damage arising from your failure to comply with these Account security obligations. You accept full responsibility and liability for all activities that occur under your Account.
4.4 Account Deactivation
We reserve the right, at our sole discretion, to deactivate, suspend, or delete any Account, with or without notice, for any reason, including but not limited to inactivity, breach of these Terms, or if we have reason to believe that the account has been compromised.
5. DESCRIPTION OF SERVICES
Through the Platform, Farz Academy offers, among other things, the following Services:
- •Online preparatory courses for MRCP Part 1, MRCP Part 2 Written, and MRCP
PACES examinations.
- •Online preparatory courses for the EDIC (European Diploma in Intensive Care)
examination.
- •Live interactive online classes conducted by qualified medical faculty.
- •Pre-recorded video lectures and study materials.
- •A question bank comprising 750+ practice questions with detailed explanations.
- •Mega Mock Tests designed to simulate examination conditions.
- •Webinars conducted by expert faculty and guest speakers.
- •Residential PACES preparation programmes (subject to availability).
- •Mentor support and chat assistance.
- •A newsletter subscription service providing updates and study tips.
The specific features, content, and format of each Course are described on the relevant Course page on the Platform. We reserve the right to modify, update, suspend, or discontinue any Service or Course (or any part thereof) at any time, with or without notice. While we endeavour to provide advance notice of material changes,
we shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Services.
6. COURSE ENROLMENT AND ACCESS
6.1 Enrolment
Course enrolment is confirmed upon successful payment of the applicable Fee. A confirmation of enrolment will be sent to your registered email address. Enrolment grants you a limited, non-exclusive, non-transferable, and revocable licence to access and use the relevant Course materials solely for your personal, non-commercial educational purposes during the access period specified at the time of purchase.
6.2 Access Period
Your access to Course materials is valid for the period stated on the Course page at the time of enrolment ("Access Period"). We reserve the right to extend the Access Period at our discretion. Upon expiry of the Access Period, access to the Course materials will automatically cease. No refund or credit will be provided in respect of any unused portion of the Access Period.
6.3 Live Classes and Webinars
Live online classes and Webinars are conducted at scheduled dates and times notified to enrolled Users in advance. We will endeavour to record live sessions where technically feasible and make recordings available to enrolled Users; however, we do not guarantee that all sessions will be recorded or that recordings will be available indefinitely. Session schedules are subject to change; we will endeavour to provide reasonable notice of any changes.
6.4 Technical Requirements
You are responsible for ensuring that your device, internet connection, and software meet the minimum technical requirements for accessing the Platform and participating in live sessions. We shall not be liable for any failure to access or use the Services arising from inadequate technical infrastructure on your end.
6.5 Course Completion
Certificates of completion or participation, if offered, will be issued subject to the conditions stated on the relevant Course page. The Company does not guarantee any specific outcome, examination result, or professional certification as a result of completing any Course.
7. FEES, PAYMENTS, AND BILLING
7.1 Fee Structure
Fees for Courses and other paid Services are as displayed on the Platform at the time of purchase. All Fees are stated in Indian Rupees (INR) unless otherwise specified. Fees are exclusive of applicable taxes, including Goods and Services Tax (GST), which shall be payable in addition to the stated Fee where applicable.
7.2 Payment Methods
Payments must be made through the secure payment gateway(s) made available on the Platform. Accepted payment methods are displayed at the point of checkout. By submitting payment, you represent and warrant that the payment information provided is accurate and that you are authorised to use the chosen payment method. The Company does not store your complete payment card details on its servers; all payment transactions are processed by third-party payment gateway providers.
7.3 Promotions and Discounts
From time to time, the Company may offer promotional pricing, discount codes, or festive offers. Such offers are valid only for the period specified and are subject to their own terms and conditions. The Company reserves the right to withdraw or modify any promotion at any time without prior notice.
7.4 Failed Payments
If a payment is declined, reversed, or charged back for any reason, your access to the relevant Course or Service may be suspended immediately until the payment issue is resolved. The Company shall not be liable for any interruption to your access arising from a failed or disputed payment.
7.5 Invoicing
Upon successful payment, you will receive a payment receipt or invoice at your registered email address. It is your responsibility to retain this document for your records. For any billing queries, please contact us at info@farzacademy.com.
8. REFUND AND CANCELLATION POLICY
8.1 General Rule
All Fees paid for Courses and Services are, as a general rule, non-refundable once access to Course materials has been granted, except as expressly provided in this clause 8 or as required by applicable law, including the Consumer Protection Act, 2019.
8.2 Refund Eligibility
A refund request may be considered in the following circumstances only:
- •The Course for which you enrolled is cancelled by the Company prior to
commencement.
- •You have been incorrectly charged an amount different from the published price
for the relevant Course.
- •A technical error caused by the Company has prevented you from accessing any
Course content whatsoever within 7 days of enrolment, and you have reported the issue to us within that period.
8.3 Refund Request Procedure
To request a refund, you must contact us at info@farzacademy.com within 7 days of the relevant event giving rise to the refund claim, providing your name, registered email address, Course name, payment reference number, and a detailed description of the reason for your request. We will assess your request and respond within 10 working days. If a refund is approved, it will be processed via the original payment method within 7–14 working days, subject to the processing timelines of the relevant payment provider.
8.4 Non-Refundable Items
The following are not eligible for a refund under any circumstances:
- •Enrolment fees for any Course that has been accessed or partially completed.
- •Fees for mock tests or question bank access once access has been granted.
- •Webinar registration fees once the Webinar has taken place.
- •Fees for any Course that has been partially or fully consumed.
- •Discounted, promotional, or bundled Course fees, unless otherwise stated.
8.5 Cancellation by the Company
The Company reserves the right to cancel any Course or Webinar at any time. In such an event, enrolled Users will be notified by email and will receive either a full refund of the Fees paid or, at the Company's discretion, an equivalent credit applicable towards another Course.
9. INTELLECTUAL PROPERTY RIGHTS
9.1 Ownership
All Content available on the Platform, including but not limited to course videos, lectures, slides, practice questions, model answers, explanations, study notes, Webinar recordings, trademarks, logos, graphic designs, and the underlying software and technology of the Platform, is owned by or licensed to Farz Auxiliar Academy Private Limited and is protected under the Copyright Act, 1957, the Trade Marks Act, 1999, and other applicable Indian and international intellectual property laws.
9.2 Limited Licence to Users
Subject to your compliance with these Terms and payment of applicable Fees, the Company grants you a limited, personal, non-exclusive, non-transferable, revocable licence to access and view the Course Content solely for your own lawful, noncommercial educational purposes during the applicable Access Period.
9.3 Restrictions
You must not, without the Company's prior written consent:
- •Copy, reproduce, distribute, publish, transmit, broadcast, or make available to any
third party any Content in any form or by any means.
- •Download, record, screenshot, or extract any Content, including course videos or
question bank materials.
- •Create derivative works based on any Content.
- •Sell, sub-license, rent, lend, or otherwise commercially exploit any Content or
access to the Platform.
- •Remove, alter, or obscure any copyright, trade mark, or other proprietary notices
from any Content.
- •Use any automated tool, bot, scraper, or spider to extract or index Content.
9.4 Infringement Notices
If you believe that any Content on the Platform infringes your intellectual property rights, please notify us in writing at info@farzacademy.com with full details of the alleged infringement, including identification of the work claimed to be infringed and the location of the allegedly infringing material.
10. USER CONDUCT AND PROHIBITED ACTIVITIES
You agree to use the Platform and Services only for lawful purposes and in a manner that does not infringe the rights of others or restrict or inhibit their use and enjoyment of the Platform. Without limiting the generality of the foregoing, you must not:
- •Use the Platform for any unlawful, fraudulent, or deceptive purpose.
- •Impersonate any person or entity or misrepresent your affiliation with any person
or entity.
- •Share your Account credentials with any third party or allow any third party to use
your Account.
- •Conduct, promote, or facilitate any form of academic fraud or malpractice.
- •Post, upload, or transmit any content that is defamatory, obscene, offensive,
harassing, threatening, or discriminatory.
- •Introduce any virus, malware, trojan, ransomware, or other malicious code to the
Platform.
- •Attempt to gain unauthorised access to any part of the Platform, its servers, or
associated databases.
- •Use the Platform to send unsolicited communications (spam).
- •Engage in any activity that disrupts, degrades, or impairs the functionality or
availability of the Platform.
- •Circumvent, disable, or otherwise interfere with any security-related features of
the Platform.
- •Use the Platform for the purpose of competing with or replicating our business or
Services. We reserve the right to investigate and take appropriate legal action against any User who, in our sole discretion, violates any of the above prohibitions, including removing offending content, suspending or terminating the User's Account, and reporting the matter to law enforcement authorities.
11. USER-GENERATED CONTENT
11.1 Licence Grant
By submitting, uploading, or transmitting any User Content on or through the Platform (including feedback, forum posts, quiz responses, and testimonials), you grant the Company a worldwide, royalty-free, perpetual, irrevocable, non-exclusive licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content for the purposes of operating, improving, and promoting the Platform and Services.
11.2 Representations
You represent and warrant that: (a) you own or have all necessary rights to submit the User Content; (b) the User Content does not infringe any third-party intellectual property rights, privacy rights, or any other rights; and (c) the User Content does not contain false or misleading information.
11.3 Content Moderation
We reserve the right, but are not obligated, to monitor, review, edit, or remove any User Content at our sole discretion and without prior notice. We do not endorse or guarantee the accuracy, completeness, or reliability of any User Content.
12. PRIVACY AND DATA PROTECTION
Your privacy is important to us. Our collection, use, storage, and disclosure of personal information in connection with the Services is governed by our Privacy Policy, which is available at www.farzacademy.com/privacy-policy and is incorporated into these
Terms by reference. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy. We process personal data in accordance with the Information Technology Act, 2000, the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data or Information) Rules, 2011, and any other applicable Indian data protection legislation. If you subscribe to our newsletter or marketing communications, you may withdraw your consent at any time by clicking the "Unsubscribe" link in any such communication or by contacting us at info@farzacademy.com.
13. THIRD-PARTY LINKS AND SERVICES
The Platform may contain links to third-party websites, services, or resources (including social media platforms, payment gateways, and video hosting services) that are not owned or controlled by the Company. We provide these links for your convenience only and do not endorse the content, products, or services of any thirdparty website. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You access such third-party resources entirely at your own risk and subject to the terms and conditions of those third parties.
14. DISCLAIMERS AND WARRANTIES
14.1 Educational Purpose Only
The Content and Services provided by Farz Academy are intended solely for educational and examination preparation purposes. Nothing on the Platform constitutes professional medical advice, diagnosis, or treatment. Users should not rely on the Platform for clinical decision-making and should always seek the guidance of a qualified medical professional for any health-related matters.
14.2 No Guarantee of Examination Success
Past performance metrics, success rates, and testimonials displayed on the Platform reflect historical outcomes only and do not constitute a guarantee, representation, or warranty that you will achieve similar results. Examination outcomes depend on numerous factors beyond the control of the Company, including individual effort, prior knowledge, and examination conditions.
14.3 "As Is" Basis
To the fullest extent permitted by applicable law, the Platform and Services are provided "as is" and "as available" without warranties of any kind, either express or
implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, or availability. We do not warrant that the Platform will be uninterrupted, error-free, free of viruses or other harmful components, or that defects will be corrected.
14.4 Content Accuracy
While we make every effort to ensure that the Content is accurate, current, and up to date, medical knowledge and examination syllabi evolve over time. We do not warrant the accuracy, completeness, or currency of any Content and recommend that Users verify information from authoritative and official sources.
15. LIMITATION OF LIABILITY
15.1 Exclusion of Consequential Loss
To the maximum extent permitted by applicable law, in no event shall Farz Auxiliar Academy Private Limited, its directors, officers, employees, agents, faculty members, or licensors be liable to you for any indirect, incidental, special, consequential, punitive, or exemplary damages, including but not limited to loss of profits, loss of data, loss of goodwill, failure in any examination, interruption of business, or any other intangible loss, arising out of or in connection with your use of or inability to use the Services, even if we have been advised of the possibility of such damages.
15.2 Cap on Liability
To the maximum extent permitted by applicable law, the Company's total aggregate liability to you in connection with these Terms or your use of the Services shall not exceed the total amount of Fees actually paid by you to the Company in the 12 months immediately preceding the event giving rise to the claim.
15.3 Exceptions
Nothing in these Terms shall limit or exclude the Company's liability for death or personal injury caused by its negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under applicable law.
16. INDEMNIFICATION
You agree to indemnify, defend, and hold harmless Farz Auxiliar Academy Private Limited and its directors, officers, employees, agents, licensors, and service providers from and against any claims, liabilities, damages, judgements, awards, losses, costs, expenses, and fees (including reasonable legal fees) arising out of or relating to: (a) your violation of these Terms; (b) your use or misuse of the Platform or Services; (c) your violation of any applicable law or regulation; (d) your infringement of any thirdPage 10 | © 2026 Farz Auxiliar Academy Private Limited. party intellectual property or other rights; or (e) any User Content you submit to the Platform.
17. TERM AND TERMINATION
17.1 Duration
These Terms come into force on the date you first access the Platform or create an Account and remain in force until terminated in accordance with this clause 17.
17.2 Termination by Us
We may, at our sole discretion and without prior notice, suspend or terminate your Account and access to all or any part of the Services if: (a) you breach any provision of these Terms; (b) we are required to do so by applicable law or a court order; (c) we reasonably suspect fraudulent, abusive, or illegal activity associated with your Account; or (d) we discontinue the Services for any reason.
17.3 Termination by You
You may close your Account at any time by contacting us at info@farzacademy.com. Termination of your Account will not entitle you to any refund of Fees already paid, except as expressly stated in clause 8.
17.4 Effect of Termination
Upon termination of your Account or access to any Course: (a) your licence to access the relevant Course materials immediately ceases; (b) any outstanding Fees remain due and payable; and (c) clauses 9, 14, 15, 16, 19, and 20 shall survive termination.
18. FORCE MAJEURE
The Company shall not be liable for any delay or failure to perform any obligation under these Terms to the extent that such delay or failure is caused by a Force Majeure Event. A "Force Majeure Event" means any event beyond the Company's reasonable control, including but not limited to acts of God, floods, earthquakes, epidemics, pandemics, government actions, internet or telecommunications outages, power failures, or civil unrest. The Company will endeavour to notify affected Users of any Force Majeure Event and to resume Services as soon as reasonably practicable.
19. GOVERNING LAW AND DISPUTE RESOLUTION
19.1 Governing Law
These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the Republic of India.
19.2 Jurisdiction
Subject to clause 19.3 below, you irrevocably agree that the courts of Kolkata, West Bengal, India shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.
19.3 Arbitration
Any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, may, at the sole discretion of the Company, be referred to and finally resolved by arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted by a sole arbitrator mutually appointed by the parties, or, failing agreement, appointed in accordance with the said Act. The seat of arbitration shall be Kolkata, West Bengal, India, and proceedings shall be conducted in English.
19.4 Consumer Disputes
Nothing in this clause 19 shall be construed so as to restrict or limit the rights of a consumer User to seek redressal before the appropriate Consumer Disputes Redressal Commission established under the Consumer Protection Act, 2019.
20. AMENDMENTS TO THESE TERMS
We reserve the right to amend, modify, or update these Terms at any time. We will notify you of material changes by posting the revised Terms on the Platform and, where appropriate, by sending an email to your registered email address. The "Last Updated" date at the top of this document will be revised accordingly. Your continued use of the Platform after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must discontinue use of the Platform and may close your Account.
21. GENERAL PROVISIONS
21.1 Entire Agreement
These Terms, together with the Privacy Policy and any Course-specific terms notified to you at the time of enrolment, constitute the entire agreement between you and the
Company with respect to your use of the Platform and Services and supersede all prior agreements, understandings, negotiations, and discussions, whether oral or written.
21.2 Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be deemed modified to the minimum extent necessary to make it enforceable, or, if it cannot be so modified, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.
21.3 Waiver
No failure or delay by either party in exercising any right, power, or remedy under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any right, power, or remedy preclude any further exercise of that or any other right, power, or remedy.
21.4 Assignment
You may not assign, transfer, or sub-contract any of your rights or obligations under these Terms without the prior written consent of the Company. The Company may assign these Terms, or any of its rights or obligations hereunder, without restriction.
21.5 Notices
Any notice required or permitted under these Terms shall be in writing and shall be delivered to the Company at info@farzacademy.com or to the address stated in clause 22 below. Notices to you shall be sent to your registered email address.
21.6 Language
These Terms are drafted in the English language. In the event of any inconsistency between the English version and any translated version, the English version shall prevail.
